Description: 77 single-family residential lots, 2 drainage lots and 1 open space lot on 15.9 acres
The subject property is located on the west side of Highway 46 South across the highway from Avery Park Subdivision in Guadalupe County. A master plan for Deer Crest was approved in 2016 and Unit 1 of the subdivision is recorded. A portion of the subdivision along Highway 46 is located within the New Braunfels city limits; however, all the proposed residential units are outside the city limits in the ETJ.
Drainage:
The Public Works Department reviewed the final project drainage with the approved construction plans as required by Section 118-51.e of the Subdivision Platting Ordinance and in accordance with the requirements of Chapter 143 Municipal Drainage Utility Systems, and the Drainage and Erosion Control and Design Manual.
No portion of the subject property is located within the 1% annual chance floodplain.
Utilities:
Sewer and electric services are provided by New Braunfels Utilities, and water by Springs Hill Water Supply. Utility easements have been designated on the plat as requested.
Transportation:
Regional Transportation Plan
Highway 46 South is designated as a Principal Arterial. Right-of-way for a right-turn deceleration lane into the subdivision was dedicated with Unit 1.
Access
Unit 2 extends Deer Crest Drive, the main subdivision entrance from Highway 46 platted with Unit 1. It also connects to Unit 1 on Indian Wheat which provides secondary access from Elley Lane Subdivision to the south. Indian Wheat is stubbed to the north for a future connection when adjacent property is developed. A hammerhead will be constructed at the end of Indian Wheat to provide a temporary turnaround until the street is extended.
Hike and Bike Trail Plan
This plat is in compliance with the City’s Hike and Bike Trails Plan. There are no existing or proposed trails internal to or adjacent to the subject property.
Sidewalks
Four-foot wide sidewalks will be constructed adjacent to the curb, as approved with the master plan, along all internal streets in Unit 2.
Roadway Impact Fees:
All lots in Unit 2 are outside the City limits and the Roadway Impact Fee Study Area. Therefore, no Roadway Impact Fees are assessed with this plat.
Parkland Dedication and Development:
This subdivision is subject to the 2006 Parkland Dedication and Development Ordinance and includes 77 new dwelling units. The developer has platted a 2.67-acre HOA park in Unit 1 for construction of the subdivision amenity center. If the park and amenities are not in place and accepted prior to recordation of this plat, in lieu fees must be paid and eligibility for reimbursement will be determined when amenities are complete. Park fees in the amount of $46,200 ($600 per dwelling) are payable to the City prior to recording the final plat.
Staff Recommendation:
To meet the requirements of the Subdivision Platting Ordinance and other adopted codes, the applicant’s proposed final plat must comply with the conditions noted below. Staff recommends approval of the applicant’s proposed final plat the following Conditions of Approval:
1. Add an index sheet showing the entire subdivision at an appropriate scale to Sheet 1. (NBCO 118-29(a))
2. Label the adjacent property ownership with recorded deed document information on Sheet 3. (NBCO 118-24(4) & (5))
3. Park Land Dedication and Development fees in the amount of $46,000 must be paid prior to plat recordation if the subdivision park and amenities are not in place and accepted prior to recordation of this plat. (NBCO 118-60)
4. Add a plat note stating “This subdivision is within the Conical Zone of the Airport Hazard Zoning District and is subject to Airport Hazard Zoning District Standards and Regulations.” (NBCO 118-24(15))
5. Remove the signature line for Spring Hills Water Supply. (NBCO 118-30)
6. Add the signature block for NBU. (NBCO 118-30(d))
Approval Compliance:
Pursuant to state law, if the Planning Commission approves with conditions, to obtain approval of the final plat, the applicant must submit to the City a written response that satisfies each condition of approval prior to expiration of the final plat (Section 118-32(k)). In accordance with Chapter 212, Texas Local Government Code, the City will determine the final plat approved if the response adequately addresses each Condition of Approval.
