BACKGROUND INFORMATION:

Staff has received a request for encroachments in the public right-of-way associated with this development to install raised planter beds, raised porches/terraces, awnings, canopies, and balconies, within and over the right-of-way of West San Antonio Street at the intersection of South Guenther Avenue.  Staff has reviewed the encroachments and determined they do not have a negative impact on the right-of-way and should be permitted. 

 

Section 114-7(e) of the City of New Braunfels code of ordinances requires an annual fee of 10% of the value of the land for surface encroachments and 7.5% of the value of the land for aerial encroachments.  Based on the calculations of the encroachment area, the annual fee assessed for these encroachments will be $4,320.

 

 

ISSUE:

Section 114-7(e) of the City of New Braunfels Code of Ordinances outlines the requirements pertaining to applicants wishing to install encroachments within the city right-of-way.
