BACKGROUND INFORMATION:

At the previous board meetings in March and June a presentation and workshop were conducted by the Board on amending the local dangerous dog ordinance. The City of New Braunfels’ current vicious or dangerous dog ordinance has been in place for many years and needs to be updated. With recent dangerous dog incidents in the news in other towns, the City of New Braunfels Animal Welfare and Rescue Division is proposing amendments to the current ordinance to provide consistency with the state and other municipalities.

One example of a change is that the current ordinance states a member of the New Braunfels Police Department or a designee is to hear a case to determine if a dog is dangerous. Proposed changes would codify current practice which is that the New Braunfels Animal Welfare and Rescue Division will be able to make this determination after investigating all the evidence on a case. This process is also similar to how the state statute is currently set up.

ISSUE:

New Braunfels’ current dangerous dog ordinance is not consistent with the State of Texas dangerous dog rules.
