BACKGROUND INFORMATION:

The City of New Braunfels established the Roadway Impact Fee Ordinance in 2007. That ordinance authorized the City to impose roadway impact fees on new development within the corporate boundaries of the City to recover the incremental cost of each new unit of development in terms of new infrastructure needs.

Maximum roadway impact fees were determined by a transportation study, which is updated every five years, and includes service areas, land-use assumptions, and a transportation capital improvement plan. However, the actual fee assessed is at the discretion of the City of New Braunfels City Council, so long as it does not exceed the actual impacts of new development on the city’s transportation network.

Previously, the City’s Planning Commission operated as the Roadway Impact Fee Advisory Committee in accordance with Chapter 395 of the Texas Local Government Code. However, changes to the code on September 1st, 2025 resulted in the formation of this committee.
