Description:                     A 17.49-acre final plat establishing 86 lots for residential use and 2 lots for drainage purposes.

 

The proposed Southpoint Subdivision is a single-family residential development located just south of the Legend Point subdivision, on the southwest side of the city, south of the future intersection of Legend Pond Road and W. Zipp Road. The entire Southpoint subdivision is located within the city limits of New Braunfels and within Guadalupe County. The approved master plan for the subdivision consists of a total of 7 units, 131.58 acres, and approximately 500 residential lots.

 

ISSUE:

This final plat is approximately 17.5-acres and proposes the establishment of 86 residential lots, dedication of rights-of-way, and common area lots for open drainage, utilities, and access.

 

Drainage:

The Public Works Department reviewed and approved final project drainage with the construction plans as required by Section 118-51(e) of the Platting Ordinance and in accordance with the requirements of Chapter 143 Municipal Drainage Utility Systems and the Drainage and Erosion Control Design Manual.

 

Utilities:

Water will be provided by Green Valley Special Utility District and wastewater will be provided by Guadalupe Blanco River Authority. 20-foot-wide public utility easements are being dedicated along street frontages. Utilities will be extended as part of this plat in accordance with the approved construction plans.

 

Transportation:

This proposed plat is in compliance with the City’s Regional Transportation Plan (RTP) and the approved master plan for the overall development.

 

Sidewalks and Accessways:

our (4) foot wide sidewalks will be constructed by the developer per city standards at the time of street construction, adjacent to the curb along all other frontages abutting common area lots. Four (4) foot wide sidewalks will be constructed by the home builder per city standards adjacent to the curb at the time of building construction along all remaining street frontages. Six (6) foot wide sidewalks will be constructed by the developer along Legend Pond.

 

Roadway Impact Fees:

The subdivision is located in Roadway Impact Fee Service Area 5 and fees are hereby assessed with the approval of this plat. Impact Fees will be calculated and payable at the time of building permit based on land use at the then current rate.

 

Parkland Dedication and Development:

This final plat is located within Park District 3 and is subject to the 2018 Parkland Dedication and Development Ordinance. Per the approved Master Plan for this subdivision, land has been set aside for a private park and the developer intends to construct park improvements on the private park as a credit toward parkland ordinance requirements. As a fiscal surety, the developer is required to pay parkland dedication and development fees for the proposed single-family residential dwelling units prior to plat recordation. Up to 75% of the park development fees may be eligible for reimbursement which will be determined upon completion and acceptance of the private park. With the development of up to 86 single-family residential dwelling units, park fees in the amount of $193,156 are required to be paid prior to plat recordation.

 

This final plat is subject to the 2018 Parkland Dedication and Development Ordinance.  The developer intends to pay fees-in-lieu of park land dedication and development with no intent to construct a public or private park. With the development of 86 residential lots within this unit, park fees in the amount of $193,156 are required to be paid prior to plat recordation.

Recommendation

RECOMMENDATION:

To meet the requirements of the Subdivision Platting Ordinance and other adopted codes, the applicant’s proposed final plat must comply with the conditions noted below. Staff recommends approval of the applicant’s proposed final plat with the following Conditions of Approval:

1.                     A FEMA approved Letter of Map Revision (LOMR) is required prior to recordation of the plat. (NBCO 118-51(3))

2.                     Payment of parkland dedication and development fees, $193,156 for the 86 proposed residential lots prior to recordation of the plat. (NBCO 118-60)

3.                     A temporary turnaround is required at the southeastern terminus of Legend Pond. (NBCO 118-46(j))

4.                     Change all the bearings and distances of the outer boundary to a clockwise rotation. (NBCO 118-21(c))

5.                     A final digital plat must be submitted when proceeding with recordation the format must be in: (NBCO 118-21(c))

a.                     NAD 1983 State Plane Texas South Central FIPS 4204 (US Survey feet).

b.                     Grid-scale.

c.                     All x-referenced files must not be in blocks.

d.                     Dwg format 2018 version or earlier.

 

Approval Compliance:

To obtain final approval of the plat, the applicant must submit to the City a revised plat and written response that satisfies each condition of approval prior to the expiration of the plat (Sec. 118-32(b)).  In accordance with chapter 212, Texas Local Government Code, the City will determine the plat approved if the response adequately addresses each Condition of Approval.
