BACKGROUND INFORMATION:

The City of New Braunfels established the Roadway Impact Fee Ordinance in 2007. That ordinance authorized the City to impose roadway impact fees on new development within the corporate boundaries of the City to recover the incremental cost of each new unit of development in terms of new infrastructure needs.

 

The establishment and collection of Roadway Impact Fees is governed by Chapter 395 of the Texas Local Government Code and Chapter 100 of the New Braunfels Code of Ordinances. The code requires municipalities to conduct a new study every five years. Each new study evaluates the established service areas, land-use assumptions, and proposed capital improvements to determine the maximum assessable fee for each service area.

 

The City last updated the Roadway Impact Fee Study in 2020 and began the required five-year update in 2025. Legislative changes enacted on September 1, 2025, altered public hearing timelines, the makeup of the Impact Fee Advisory Committee, and implemented a new requirement for an independent financial audit. These changes impacted the City’s timeline for adoption.

 

Kimley- Horn and Associates is conducting the 2026 Roadway Impact Fee Study. The firm will provide an update on the study, share the background and basics of the Roadway Impact Fee program and provide an update on the recent legislative changes.

 

In accordance with the requirements of Chapter 395, the City will bring several items forward for public hearing and action over the next few months. Below is a summary of the study adoption timeline:
