Description: Residential replat to create two (2) residential lots from one platted lot.
ISSUE:
The subject property is 31,250 square feet (0.718 acres) and is currently on the corner of Madeline Street and Lori Lane. The replat is for the creation of two (2) residential lots from one lot. Currently, the property has one residence, a metal storage building and a carport located on it. The residence was built in 1951. The resulting lots from the proposed replat are intended for residential use in compliance with R-2 (Single-Family and Two-Family District).
Drainage:
The Public Works Department reviewed project drainage with the Letter of Certification (LOC) process as required by Section 118-51(e) of the Subdivision Platting Ordinance and in accordance with the requirements of Chapter 143 Municipal Drainage Utility Systems and the Drainage and Erosion Control Design Manual. The proposed replat will maintain existing drainage conditions on the property.
Utilities:
NBU has indicated that separate utility services are required for each platted lot. Electric, water and wastewater services will be provided by NBU. Connections for water and wastewater must be provided from the property to the nearest point of connection to NBU's system(s) in accordance with NBU's design standards and NBU' s Water Connection Policy at the applicant' s cost.
Transportation Plan:
The project is not proposing streets within the subdivision. The northern boundary of this replat is along Lori Lane which is designated as a minor collector on the City’s Regional Transportation Plan. Right of Way dedication may be required along the Lori Lane frontage in accordance with the City standards.
Hike and Bike:
The replat is in compliance with the City’s Hike and Bike Trails Plan. There are no bike lanes or off-street paths indicated on the plan along the subject property.
Sidewalks:
Four (4) foot wide sidewalks are required to be constructed at the time of redevelopment along Lori Lane and Madeline Street.
Roadway Impact Fees:
The subdivision is located within Roadway Impact Fee Service Area 1.
Parkland Dedication and Development:
This subdivision is subject to the City’s 2018 Parkland Dedication and Development Ordinance. The developer is required to pay parkland dedication and development fees for the proposed additional residential home site prior to plat recordation. With the development of one additional residential dwelling unit, park fees in the amount of $2,246 are required to be paid prior to recordation.

The proposed replat meets the following action items & goals of Envision New Braunfels:
• Action 1.3: Encourage balanced and fiscally responsible land use patterns.
• Action 3.1: Plan for healthy jobs/housing balance.
• Action 3.13: Cultivate an environment where a healthy mix of different housing products at a range of sizes, affordability, densities, amenities, and price points can be provided across the community as well as within individual developments.

Economic Mobility - Output: Increase the number of new affordable housing units produced each fiscal year.
FISCAL IMPACT:
The proposed replat is in alignment with the following Land Use Fiscal Analysis action item:
• Prioritize infill projects that add people and buildings in areas with existing infrastructure. This will increase tax revenue without significant impacts on services and infrastructure costs and distribute cost burdens across more home/ business owners.
Recommendation
RECOMMENDATION:
To meet the requirements of the City's Subdivision Platting Ordinance and other adopted codes, the plat must comply with the conditions noted below. Staff recommends approval of the proposed replat subject to the following Conditions of Approval:
1. Payment of parkland dedication and development fees, $2,246, for the proposed additional residential lot prior to plat recordation. (NBCO 118-60(b))
2. Revise Plat Note #10 to state: Four (4) foot wide sidewalks will be constructed by the home builder per city standards at the time of building construction along:
a. Lori Ln
b. Madeline St
3. Add the centerline and dimensions for Madeline St. and Lori Ln. (NBCO 118-29(b))
4. Lori Ln. is a 60-foot wide Minor Collector according to the Regional Transportation Plan and will require right-of-way dedication in accordance with platting standards. (NBCO 118-46 (s)(7))
5. Be advised water and wastewater service connections are required to serve Lot 76B; this will include impact fee payment to New Braunfels Utilities (NBU) prior to water meter installation. (NBCO 118-51(a))
6. Be advised that water and wastewater capacity is not reserved until construction documents and plat approval. (NBCO 118-31(a))
7. Be advised final acceptance or performance bond for utility construction is required prior to plat approval. (NBCO 118-31(a))
8. Be advised that capital improvement projects addressing capacity issues as noted on Letters of Certification for utilities may be required to be completed prior to plat approval. (NBCO 118-21(d))
Approval Compliance:
To obtain approval of the final plat the applicant must submit to the City a written response that satisfies each condition of approval prior to expiration of the final plat (Section 118-32(b)). In accordance with Chapter 212, Texas Local Government Code, the City will determine the final plat approved if the response adequately addresses each Condition of Approval.
Mailed notification:
A public hearing notice was sent to the owner of 15 property within 200 feet. To date no responses have been received.
