BACKGROUND INFORMATION:

The City of New Braunfels has an existing 2008 Interlocal Agreement (ILA) with Comal County related to subdivision regulation within the city’s extraterritorial jurisdiction. Currently, the ILA does not specify which government entity is responsible for oversight of enforcement, permits and inspections relating to the City’s adopted International Fire Code for commercial occupancies.  The attached amendment identified the City as the being responsible. Both water district entered into development agreements and strategic partnership agreements with the City as required by law.  The ILA amendment was approved by the Comal County Commissioners Court on July 2, 2024.

 

 

ISSUE:

Without these permits and inspections being recognized in the existing ILA the duty to perform them falls upon the Comal County Fire Marshals Office. Having the same municipality reviewing both building and fire codes provides a better process for the developer.

Saff recommends approval of an amendment to an Interlocal Agreement with Comal County for development inspections within the ETJ, specifically the developments of Mayfair and Veramendi water districts.
