The City Council held a public hearing on August 28, 2023 and unanimously approved the first reading of the applicant’s requested ordinance (7-0-0).
The 16.064 acre subject property is occupied by an elementary school located within the Veramendi Sector Plan 1 on the northwest side of the intersection of Oak Run Parkway and Geneva Street. The subject property is situated approximately 0.75 of a mile to the north of State Highway 46. The applicant is requesting a Type 2 Special Use Permit for the placement of five (5) portable classroom buildings on the school property.

ISSUE:
The applicant’s request is consistent with the following actions from Envision New Braunfels:
• Action 1.3: Encourage balanced and fiscally responsible land use patterns.
• Action 2.1: Sustain community livability for all ages and economic backgrounds.
• Action 3.48: Create student-friendly spaces for studying and project related work.
The applicant has indicated that the portable classroom buildings are temporary and will be removed when they are no longer needed, for a period not to exceed five years.

Recommendation
RECOMMENDATION:
Staff recommends approval of the Type 2 Special Use Permit with the following condition:
• The five (5) portable classroom buildings are temporary and must be removed the sooner of either when they are no longer in use or five years from the date of approval (proposed September 11, 2023).
The Planning Commission held a public hearing on August 1, 2023, and unanimously recommended approval (6-0-0).
Mailed notification as required by state statute:
Public hearing notices were sent to owners of 45 properties within 200 feet of the request. To date, the city has received responses representing 7% in opposition.
