BACKGROUND INFORMATION:
Sec 114-7(e) of the City of New Braunfels Code of Ordinances outlines the requirements pertaining to applicants wishing to construct an encroachment within city right of way.
ISSUE:
Staff has received a request for an encroachment in the unimproved portion of the public right of way of Weltner Road within the Legacy at Lake Dunlap Subdivision for the installation of landscaping, landscape elements, decorative fencing and temporary development signage. Staff has reviewed the encroachment and has determined it has no negative impacts on the right of way and should be permitted.
FISCAL IMPACT:
Sec 114-7(e) of the City of New Braunfels Code of Ordinances requires aerial encroachments must pay an annual license fee of 10% of the value of the land to be licensed with a minimum annual license fee of $100. The calculated annual license fee for this encroachment is $100.
