BACKGROUND INFORMATION:

The City of New Braunfels established the Roadway Impact Fee Ordinance in 2007. This ordinance authorized the City to impose impact fees on new development within the corporate boundaries of the City to generate revenue for funding or recouping the costs of capital improvements or facility expansions necessitated by and attributable to new development. The City last updated the Roadway Impact Fee Study and Ordinance in 2020.

The City is required by state statute to review the land use assumptions and roadway improvements for roadway facilities at least every five years. The City Council must then decide on whether changes to the land use assumptions, capital improvements plan, or impact fees are needed and shall, in accordance with the procedures set forth in the Texas Local Government Code, Chapter 395, either update the fees or decide that no update is necessary. The City has appointed a Roadway Impact Fee Advisory Committee (RIFAC) which acts in an advisory capacity for the City Council.

The City initiated the Roadway Impact Fee Update in 2025 to update the land use assumptions, capital improvements plan, and impact fee policy. The City retained Kimley-Horn and Associates, Inc. to provide professional services to develop the roadway impact fee update and report. The report contains a detailed discussion of the inputs and methodology for the computation of the impact fees and specific impact fee calculations for each of the six service areas in New Braunfels. The report provides the maximum roadway impact fee per vehicle-mile for each service area. The link to the report is www.newbraunfels.gov/rif <http://www.newbraunfels.gov/rif>.

The following items were completed as required by Chapter 395 in order to adopt the study:

•                     The draft study was made publicly available on the City’s website on June 25th, 2026.

•                      An impact fee audit was conducted, and a public hearing on that audit was held on September 14, 2026, during the regular City Council meeting.

•                      The City published a public notice in the local newspaper on September 19, 2026.

•                     City Council took action to establish a public hearing date at the September 28, 2026, meeting.

This agenda item is to approve the update to the Roadway Impact Fee Study, including the land use assumptions, capital improvement plan, and maximum assessable fee.

Discussion and direction by City Council regarding updating the collected fee rate and establishing an effective date will occur under a separate agenda item on tonight’s agenda.
