BACKGROUND INFORMATION:
On June 24, 2024, the City Council approved construction funding for the Common Street Pedestrian Improvement project from the 2023 Bond Fund. This approval included the federal participation portion of the agreement with the Alamo Area Metropolitan Planning Organization, up to 80%, or $1,478,910, for any participating construction items. All non-participating and construction overage items are the responsibility of the City of New Braunfels, which was funded by the New Braunfels Economic Development Corporation (NBEDC) in an amount not to exceed $700,000.
City Council approved a 10% contingency of $158,301, with the original contract. However, as construction has progressed, several utility conflicts were identified, and design revisions and construction costs to address these conflicts are not part of the federal participation reimbursement items. Additional conflicts are anticipated before the completion of the project, and an increase in contingency is necessary. Staff requests an increase to the project contingency of $150,000, taking contingency from $158,301 to $308,301, utilizing a portion of the remaining available funds allocated by the NBEDC.

FISCAL IMPACT:
The NBEDC has approved funding up to $700,000 for the construction phase of this project. The total spend, including the proposed increase to the contingency amount, remains within that $700,000 funding amount, therefore, sufficient funds are available.
