The subject property is located on the northbound side of IH 35 South between Doeppenschmidt Road and Solms Road and fronts the northbound IH 35 access road. The 3-acre subject property is currently undeveloped.
The applicant is seeking approval of a zoning change from “APD” Agricultural/Pre-Development District and “M-1” Light Industrial District to “M1-A” Light Industrial District with the intention of developing the site for retail and assembly of portable buildings and swing sets.

ISSUE:
The proposed rezoning is consistent with the following actions from Envision New Braunfels:
• Action 1.3: Encourage balanced and fiscally responsible land use patterns.
• Action 1.6: Incentivize infill development and redevelopment to take advantage of existing infrastructure
Future Land Use Plan: The property lies within the Oak Creek Sub Area in the IH 35 Transitional Mixed-Use Corridor near existing Market Centers, and near future Market and Employment Centers.

Recommendation
RECOMMENDATION:
Approval. The requested M-1A zoning is consistent with the existing industrial and commercial developments along the IH 35 corridor, is supported by Envision New Braunfels, and will provide consistent zoning development standards across the property.
The Planning Commission held a public hearing on January 4, 2022 and unanimously recommended approval (8-0, with Commissioner Tubb absent).

Public hearing notices were mailed to owners of 3 properties within 200 feet of the subject property. Staff has received one response in favor from property #2, and none opposed.
