BACKGROUND INFORMATION:
The City is the owner of certain rights-of-way known as Hanz Drive, Cotton Gin, Cotton Blvd., Cotton Crossing Ln., Vineyard Way, Village Path, Gruene Lake Drive, Bergstrom Blvd., and Janets Way located within the Cotton Crossing Subdivision in the City of New Braunfels.
The Cotton Crossing Owners Association has requested to allow the use of non-conforming signs and decorative support posts within the right-of-way to maintain the aesthetic of their subdivision. The non-conforming signs and decorative support posts were installed with the initial construction of the Cotton Crossing subdivision between 2000 and 2012. The agreement officially allows the continued use of existing non-conforming signs and decorative support posts in the right-of-way with agreed-upon conditions. The installation of new signs and support posts by the City of New Braunfels will conform to established standards.
ISSUE:
City staff favors allowing the existing non-conforming signs and decorative support posts to remain within the right-of-way, subject to the conditions set forth in the attached agreement. The Owners Association will maintain sole ownership of the improvements, and the City shall have no responsibility to maintain, repair, or replace the non-conforming signage. The Owners Association must also provide liability insurance covering the improvements located within the right-of-way.
