BACKGROUND INFORMATION:
AG Sunflower Ridge LLC is the developer of the Sunflower Ridge Subdivision, located within the city limits and adjacent to Goodwin Lane and Orion Drive. The developer has received approval for the master plan, which includes 251 single-family dwelling units.
The developer is required to construct improvements at Orion Drive and Nebel Street and FM 1102 as part of the master plan and associated traffic impact analysis (TIA). The section of Orion Drive within the city limits is on the city’s Roadway Impact Fee Capital Improvement Program.
Recent utility work and associated pavement repairs have improved Orion Drive; however, the roadway, pavement, and drainage systems require improvement to accommodate area development. The city developed a capital project for Orion Drive, from Goodwin Lane to FM 1102, as part of the 2023 Bond Program, but it was not selected for funding. Limited improvements to Orion Drive within the city limits are planned through the 2023 Bond Citywide Streets Program, with the goal of coordinating and identifying funding with Comal County and the Texas Department of Transportation. Additionally, a railroad crossing study is underway to identify short and long-term improvements at the Orion Drive railroad grade crossing within the project limits.
The cost of the developer’s responsibility for the traffic mitigation measures is estimated at $871,085.02; however, the developer’s roughly proportionate responsibility is $693,758.90. The city reviewed the circumstances related to the requirements of the Sunflower Ridge Subdivision, in conjunction with a proposed local agency capital project, and determined that an escrow deposit for the developer’s responsibility is in the best interest of the city.
The development agreement establishes the terms and conditions for the escrow amount and associated credits against roadway impact fees.
ISSUE:
Provide a system of convenient and safe transportation facilities through comprehensive, cooperative, and continuing planning and development.
FISCAL IMPACT:
The developer will pay the City of New Braunfels $693,758.90, which represents the rough proportionality analysis amount for the traffic impact mitigation measures resulting from the development of the Sunflower Ridge Subdivision.

Staff recommends approval to authorize the City Manager to enter into a Development Agreement with AG Sunflower Ridge LLC for improvements on Orion Drive and associated credits against roadway impact fees.
