Discuss and consider approval of a resolution authorizing the City Manager to enter into an agreement for the replacement of a concrete box culvert located west of Highway 46 (Texas Loop 337) between Church Hill Drive and Manhattan Street.

BACKGROUND / RATIONALE:
In May of 2007 the City entered into an agreement with Union Pacific that allowed the City to construct a box culvert underneath a railroad bridge near Church Hill Drive to improve drainage for a nearby neighborhood.
In 2017 Union Pacific sought to replace the railroad bridge which served a now abandoned right of way drive and fill in the crossing to grade of the existing rail line. The box culvert would need to be upgraded to continue to provide drainage. Union Pacific sought financial participation from the City under the terms of the 2007 agreement.
After negotiations, Union Pacific and the City agreed to contribute $100,000 to the project in lieu of the full replacement cost. Union Pacific asked that the contribution not alter the original 2007 agreement.
