BACKGROUND INFORMATION:
The City initiated the Roadway Impact Fee Update in 2025 to update the land use assumptions, capital improvements plan, and impact fee study. The City published the final draft of the report on June 25, 2026, and presented it to the Roadway Impact Fee Advisory Committee (RIFAC) on August 18, 2026, and to City Council on September 14, 2026. Kimley-Horn and Associates, Inc. developed the roadway impact fee update and report and worked with City staff to present the study's elements to City Council and the RIFAC over multiple meetings in August, September, and October 2026.
After adopting the study, City Council must determine the roadway impact collected fee and the date when the collected fee goes into effect. The RIFAC was presented with multiple options for collected rates and requested that staff provide further information on three options for consideration, to include:
Option A - Maximum assessable fee for all land uses and service areas.
Option B - Maximum assessable fee for all land uses and services except Service Area 2. Service Area 2 would be phased to 100 % over three years.
Year 1 at 50% of maximum assessable fee
Year 2 at 75 % of maximum assessable fee
Year 3 at 100 % of maximum assessable fee
Option C - Maximum assessable fee with City Council direction for staff to develop an incentive program for the purposes of offsetting roadway impact fees that creates or incentivizes desirable growth patterns. The RIFAC would review any proposed program, and City Council would approve it before implementation.
All three options will result in an increase in the fee per development service unit compared to the current collected fee.
It is proposed that the updated collected fees are assessed for developments that have final plat approval by the City of New Braunfels on or after April 1, 2027. City staff and the consultant will present a summary of the options, including sample fees for each service area and land use, and the effective date for City Council discussion.
Upon direction from City Council, staff will update the existing ordinance with the new fee and effective date and bring it back to City Council for approval in two readings.
