BACKGROUND INFORMATION:
Staff is working on an effort to clean up the parking ordinances. This includes identifying changes to be made to existing code, outdated code to be removed, and overlaps between no parking zones, parking by permit areas, and loading zones that need to be addressed. Staff has previously brought forward revisions to parking ordinances which were approved by City Council. Staff has recently identified two additional parking by permit areas that need to be revised due to a right-of-way abandonment and a new no parking zone authorized in the last few years.
Parking by Permit Area G is located to the south of the Garden Street Public Exit of the Comal River and is generally bounded by Coll Street, Comal Avenue, and Hampe Street. It also includes the area around Lindheimer Plaza. In 2020, a no parking zone was requested along the north side of Comal Avenue adjacent to Lindheimer Plaza and on either side of the intersections with Lindheimer Street and Guada Coma Drive. This segment of Comal Avenue was located within Parking by Permit Area G. The ordinance for the no parking zone was approved, but the parking by permit ordinance was not revised at that time. Field observations show that the signs on the street accurately reflect the change from parking by permit to no parking. It is recommended to remove the portion of the parking by permit area that is now covered by a no parking zone.
Parking by Permit Area I is located to the southeast of the San Antonio Street Bridge crossing of the Comal River and the Comal River Recreation Area. It is generally bounded by San Antonio Street, S Gilbert Avenue, Coll Street, and Comal Avenue. The terminus of Tolle Street north of S Gilbert Avenue is included in this area. In 2022, this section of Tolle Street was abandoned by the city and became private property. The city’s parking by permit program is not applicable on private streets. It is recommended to remove the abandoned right-of-way from the parking by permit area.
ISSUE:
Two parking by permit ordinances for the City of New Braunfels have been identified as requiring revisions due to right-of-way abandonment and supersession by another ordinance.
FISCAL IMPACT:
Traffic control signs cost approximately $150 each. Sufficient funding is available in the FY 2024 approved streets and drainage budget.Recommendation
