BACKGROUND INFORMATION:
In accordance with Texas Government Code Chapter 791, “Texas Interlocal Cooperation Act this item requests approval for the City Manager to enter into an interlocal cooperative purchasing agreement with the 791 Purchasing Cooperative (“791 COOP”). The Intergovernmental Agreement with 791 COOP hosts contract with lead public agencies which are made available to eligible organizations, which includes cities.
This interlocal agreement offers shared procurement opportunities between governmental entities to engage in the purchase of goods and services. These agreements maximize spending power for the city and provide increased efficiency in the sourcing and purchasing of goods and services. By utilizing this agreement, the participating members will handle all governmental procurement requirements including the competitive bidding process, so the entities can immediately access contracts as need, saving time and money on the bidding and purchasing process. The City of New Braunfels utilizes several similar cooperatives, which adds capacity to the purchasing process.
The State Government Code Title 7, Chapter 791 requires an interlocal Cooperation Contract to participate in a purchasing cooperative. There is no cost associated to the use of this interlocal agreement. The agreement is effective for ten (10) years and shall automatically renew annually.

FISCAL IMPACT:
There is no cost for the issuance or use of the interlocal agreement, therefore there is not fiscal impact.

Staff recommends approval of an interlocal cooperative purchasing agreement with 791 Purchasing Cooperative in accordance with the Interlocal Cooperation Act, Chapter 791 of the Texas Government Code for goods and services.
