BACKGROUND INFORMATION:

The last time this ordinance was amended was in March 2019, in connection with revisions “relating to Water Conservation and Critical Period Management Plan, Regulated Activities, and Drought Management Plan”.  That amendment required a first and second reading and approval at that time, as well. While being responsible stewards and aiming to continue to protect essential water users, the proposed amendments to Chapter 130, Article IV, Division 7 before City Council today aim to align conservation and responsibility. The proposed amendment to Chapter 130, Article IV, Division 7 was presented to City Council at meetings on August 10, 2026, and August 24, 2026, in connection with the amendments to Chapter 130, Article IV, Division 3, 5, and 6. The amendment to Chapter 130, Article IV, Division 7 is being submitted to City Council again in an abundance of caution due to the omission of Division 7 from the language in the posted agenda for the prior meetings.

FISCAL IMPACT:

No direct fiscal impact is anticipated from the proposed revisions to Division 7. Fiscal impacts associated with drought surcharges are established through Divisions 3, 5, and 6 and may occur based on the applicable drought stage

Recommendation

RECOMMENDATION:

 The NBU Board of Trustees, at its February 26, 2026, Board Meeting, authorized NBU staff to proceed with the necessary steps to amend Chapter 130, Article IV, Division 7, of the City’s Code of Ordinances to revise drought stage designations and triggers and clarify other provisions; resolve other matters incident and related thereto; repeal all conflicting ordinances; provide a savings clause; and declare an effective date.  NBU staff recommend approval of the ordinance.
