BACKGROUND INFORMATION:

AC3 Ventures, LLC is the prospective developer of the subject property that is proposed to be rezoned for commercial use. The second and final reading of the proposed rezoning is also included on this City Council Agenda.

 

The subject property contains nearly 1,300 inches of trees that would qualify as protected under non-residential zoning requirements within the city. The developer has acknowledged the value of landscaping within the city and is committing to install plantings in accordance with the submitted Conceptual Landscape Plan that will serve to allow for commercial development of the property while providing appropriate landscaping that is in excess of current standards. The developer is also proposing the payment of $100,000 to the city as an in-lieu fee for tree removal, consistent with the separately proposed new “fee in-lieu of tree removal option” program. The in-lieu fee will be reduced upon the preservation of any protected and heritage trees that are existing on the property at the time of permitting for development. In-lieu fees will go into a fund for the city to buy trees and plant them in parks or on other public property.

 

ISSUE:

The proposed development agreement will allow for commercial development of the property to include landscaping in excess of current standards with a fee to be paid to the City for the planting of other trees on public property, allowing for the removal of existing trees and landscaping.

 

FISCAL IMPACT:

The proposed terms of the agreement include a fee in lieu of tree removal of $100,000 to be paid to the city.
