BACKGROUND INFORMATION:

Voters approved the Zipp Family Sports Park project in May 2019 as part of the 2019 Bond Program. City Council approved the Construction Manager at Risk (CMAR) delivery method for the project on December 12, 2022. SpawGlass Civil Construction, Inc. (SpawGlass) was approved by City Council as the Construction Manager at Risk (CMAR) contractor on March 27, 2023.

 

As part of SpawGlass’s preconstruction services, they reviewed the existing 90% plan set and provided the City with a construction cost estimate and a list of value engineering (VE) options. On July 6, 2023, staff presented to City Council and the New Braunfels Economic Development Corporation (NBEDC) an update on the project. The update included the current project funding, VE options staff accepted and VE options for City Council to consider. After receiving direction from Council and additional funding from the NBEDC, the design team led by Norris Design and Walker Partners Engineering updated the plans to reflect the accepted changes.

 

To begin construction sooner, the construction plans were divided into two packages. Package 1 included the grading and erosion control components. Package 2 includes the remaining project components, including utilities, paving, playing fields, irrigation, and other project elements. The Guaranteed Maximum Price (GMP) for Package 1 was approved by City Council on October 9, 2023, in the amount of $4,833,226.00.

 

The City’s design team submitted the Package 2 plan set on October 16, 2023. Upon receiving the plan set SpawGlass began to develop a GMP. The GMP sets the maximum construction cost of the project package and places the risk associated with bidding the project on the CMAR. SpawGlass has also begun soliciting bids from subcontractors for the work. When the bids are received the pricing is reviewed and accepted by the City. If the bids received are higher than the GMP, the contractor is responsible for the overage. If the bids received are lower than the GMP, the savings are split between the City and SpawGlass at an 80% / 20% ratio. The subcontractor bids for SpawGlass are due December 4, 2023.

 

SpawGlass has submitted a GMP for Package 2 in the amount of $24,656,802. This is within the overall construction budget for the project, which is $29,500,000.

                     Total Project GMP: $29,490,028

The addition of $2,550,000 in owner-controlled contingency for the project brings the total available construction funds for the project to $32,040,028, which is within the overall project budget.

 

As part of the construction process, a materials testing contract is necessary. A task order was issued utilizing the City’s Indefinite Delivery Indefinite Quantity (IDIQ) delivery method for materials testing. The task order was issued on September 22, 2023, and the City received seven responses on October 11, 2023. City Staff reviewed and scored each of the responses. The evaluation committee selected Terracon Consultants, Inc. (Terracon) based on the scoring of their solicitation response.

 

Terracon submitted a not-to-exceed scope and fee of $272,840 for materials testing, which is within the established project budget.

FISCAL IMPACT:

Funding for the Zipp Family Sports Park is located within the 2019 Bond Program Fund; therefore, sufficient funds are available.

Authorization for the City Manager to execute a Guaranteed Maximum Price Amendment with SpawGlass Civil Construction, Inc. for the Zipp Family Sports Park, as a contract with Terracon Consultants, Inc. for construction materials testing, and authorization for the City Manager to execute any change orders up to the contingency amount.
