BACKGROUND INFORMATION:
At the previous board meeting in March a presentation was provided to the board on the proposal of amending the local dangerous dog ordinance. The City of New Braunfels’ current vicious or dangerous dog ordinance has been in place for many years and needs to be updated. With recent incidents of dangerous dog cases in the news the City of New Braunfels Animal Welfare Division would like to amend the current ordinance to provide consistency with the state and other municipalities.
One example of a change requires a member of the New Braunfels Police Department or a designee to hear a case to determine if the dog is dangerous. With changes to the current ordinance the New Braunfels Animal Welfare Division will be able to make this determination after investigating all the evidence on the case. This process is similar to how the state statute is currently set up.
ISSUE:
New Braunfels’ current dangerous dog ordinance is not consistent with the State of Texas dangerous dog rules. With the amending of the local dangerous dog ordinance, it will be consistent with the state code.

RECOMMENDATION:
This amendment is being discussed by the Animal Services Advisory Board. Any changes that are considered or discussed will be changed by staff and presented to City Council for changes to this code.
