BACKGROUND INFORMATION:

AG Sunflower Ridge, LLC is the developer of approximately 70 acres at the southwest corner of Orion Street and Goodwin Lane. On April 24, 2024, the City of New Braunfels and the developer executed a Trailhead and Trail Development Agreement for the design, construction, and dedication of a 0.33-mile segment of the Alligator Creek Trail and a 2.0-acre trailhead park featuring a playground, picnic tables, bike racks, landscaping, and other amenities. The agreement calls for dedication of the trail (by easement) and trailhead (by deed) to the City upon completion of construction.

 

 

 

 

ISSUE:

The original development agreement required the final completion of construction of the Trailhead and Trail, including all punch list items, to be completed no later than June 30, 2026. As a result of weather delays and supply issues, the developer was unable to meet this timeline. The proposed Amendment to the Development Agreement extends the deadline for final completion of construction and punch list items to no later than September 30, 2026. All other provisions of the original agreement and exhibits not in conflict with the Amendment shall remain in full force.

                     Progress toward acres of parkland per 1,000 residents metric as established by updated Parks and Recreation Master Plan.

                     Maintain National Citizen Survey overall satisfaction for “Overall health and wellness opportunities.”

 

FISCAL IMPACT:

There is no cost to the City associated with the proposed Agreement.
