BACKGROUND INFORMATION:
The City of New Braunfels adopted its Roadway Impact Fee Ordinance in 2007, authorizing the assessment of impact fees on new development within the City limits to recover the proportionate cost of roadway capacity improvements needed to serve that development. The City last updated the Roadway Impact Fee Study and Ordinance in 2020, and the current collected fee schedule was last updated in 2022.
Under Texas Local Government Code Chapter 395, the City must review its land use assumptions and roadway capital improvements plan for impact fees at least once every five years. Following that review, the City Council must determine whether updates to the land use assumptions, capital improvements plan, or roadway impact fees are warranted and, in accordance with statutory procedures, either adopt updated fees or determine that no update is necessary.
State legislative changes that became effective on September 1, 2025, required the City to reconstitute its Roadway Impact Fee Advisory Committee (RIFAC). Previously, the Planning Commission served in that role, advising the City Council on roadway impact fee matters. To comply with the new statutory requirements, the City Council appointed a new RIFAC on February 23, 2026. The updated law requires that the committee include at least three members who represent the real estate, development, or building industry and who are not employees or officials of a political subdivision or governmental entity.
The City began the roadway impact fee study update process in 2025 to review and update the land use assumptions, capital improvements plan, and impact fee policy. The City retained Kimley-Horn and Associates, Inc. to prepare the roadway impact fee update study and report. The report describes the data, assumptions, and methodology used to calculate roadway impact fees and includes fee calculations for each of the six service areas in New Braunfels. It also identifies the maximum roadway impact fee per service unit in each service area.
Kimley-Horn will present the study, Land Use Assumptions (LUA) and Impact Fee Capital Improvement Plan and the calculated maximum assessable fee. They will also facilitate discussion and answer questions regarding the study and next steps.
