BACKGROUND INFORMATION:
In 2016, City Council approved the Post Road Development Planned Development District, now known as the Heather Glen Subdivision, adjacent to Post Road and Southbound IH 35 Frontage Road. The district is being developed in five single-family residential phases and one multifamily phase. The approval of the district is subject to the condition of any mitigation measures required with the traffic impact analysis approved the City and the Texas Department of Transportation.
The City and WBW Development, LLC (WBW), the developer of the five single-family residential phases, desire to compromise and settle all issues concerning the traffic mitigation required by the single-family residential phases. WBW shall pay the City $100,000 toward the mitigation measure at Gruene Road and Post Road, and WBW shall have no further responsibility for payment or construction of mitigation measures.

FISCAL IMPACT:
Developer will pay $100,000 toward the mitigation measure at Gruene Road and Post Road. The City may utilize funds from the multifamily phase, roadway impact fee program, or other funding programs to complete the improvements.

Staff recommends approval of authorizing payments toward traffic impact analysis mitigation measures for the Post Road Development Planned Development District and authorizing the City Manager to execute the Settlement Agreement and Release.
