Title
Approval to submit a Notice of Intent and revised Storm Water Management Plan to Texas Commission on Environmental Quality for coverage under the reissued Small MS4 General Permit.

BACKGROUND / RATIONALE:
The Texas Commission on Environmental Quality (TCEQ) issued a new Phase II Small MS4 General Permit on January 24, 2019. The City is required to obtain coverage under the new general permit and must submit a Notice of Intent (NOI) and Storm Water Management Plan (SWMP) prior to July 23, 2019. The SWMP must include measures to minimize stormwater pollution, protect water quality of local surface waters and comply with the requirements of the general permit. The SWMP includes stormwater pollution prevention activities which fall under the following categories: Public Education/ Involvement, Illicit Discharge Detection and Elimination, Construction Stormwater Management, Stormwater Management in Areas of New Development, and Good Housekeeping/ Pollution Prevention for City Operations.
City staff reviewed and revised the SWMP that was developed in 2014 and implemented by the City between 2014-2019. The revised SWMP was provided to the WAC members in February 2019 for review and comment. The final draft of the SWMP was presented to the Watershed Advisory Committee on April 11th for a recommendation to move the plan forward to Council for approval.

FISCAL IMPACT:
Funding needed to implement the SWMP and comply with permit requirements are included in the FY 2018-19 General Fund Public Works-Engineering Budget.
Recommendation
COMMITTEE RECOMMENDATION:
The Watershed Advisory Committee unanimously recommended City Council approval of the revised Storm Water Management Plan and Notice of Intent.
STAFF RECOMMENDATION:
Staff recommends submittal of the Notice of Intent and revised Storm Water Management Plan to Texas Commission on Environmental Quality for coverage under the reissued Small MS4 General Permit.
