BACKGROUND INFORMATION:
Staff delivered a presentation to City Council on August 21, 2023, regarding amendments necessary to align the subdivision plat approval process with recent changes in state law. Revisions to statutes in the 2023 Legislative Session (HB 3699) allow for administrative approval of all plats, except for residential replats which would continue to be approved by the Planning Commission. Staff received direction to proceed with the amendments to the subdivision platting ordinance.
City Council held a public hearing on February 12, 2024, and unanimously approved the first reading of this ordinance (6-0-0).
ISSUE:
Amendments to the ordinance are needed to align with changes in state law.

Recommendation
RECOMMENDATION:
Staff recommends approval of the proposed ordinance revisions. The new state law shortens the platting process by no longer requiring all plats to be considered by the Planning Commission; administrative approval eliminates the need to prepare agendas and presentation materials on items that are required to be approved if they meet the adopted code standards.
The Planning Commission held a Public Hearing on November 7, 2023, and unanimously recommended approval (7-0-0), with a request to add clarification to the term “the city” regarding ultimate responsibility for various decisions.
