The subject property is 0.1492 acres and is currently addressed at 2679 Katy Street and 2662 Second Street, located approximately 50 feet east of McGaugh Avenue.

 

The applicant is requesting a change in zoning from R-2 (Single-Family and Two-Family District, with a Special Use Permit for a Duplex) to R-2 SUP (Single-Family and Two-Family District, with a Special Use Permit for Townhomes).

ISSUE:

The applicant’s submittal indicates the purpose for the change in zoning is to allow for townhome use of the property. The property was constructed as a duplex with one unit facing Katy Street (2679 Katy Street) and one unit facing Second Street (2662 Second Street). A previous SUP was approved (SUP21-234) with Ordinance No. 2021-65 to allow for a duplex on a lot less than the required minimum lot size.

 

Comal County Habitat for Humanity intends for the individual units to be sold separately after a replat of the property. The proposed lot line would be located at the firewall that was constructed between the two duplex units.

 

The use would be consistent with the following actions from Envision New Braunfels:

                     Action 1.3: Encourage balanced and fiscally responsible land use patterns.

                     Action 2.1: Sustain community livability for all ages and economic backgrounds.

                     Action 3.1: Plan for healthy jobs/housing balance.

                     Action 3.13: Cultivate an environment where a healthy mix of different housing products at a range of sizes, affordability, densities, amenities and price points can be provided across the community as well as within individual developments.

                     Action 3.15: Incentivize home development that is affordable and close to schools, jobs and transportation.

                     Action 3.16: Review and revise regulations that inadvertently inhibit creative housing options or workforce housing alternatives.

                     Action 3.30: Encourage and incentivize workforce/affordable housing to attract new workforce entrants and young families.

                     Action 3.31: Adopt policies and ordinances supportive of workforce housing, creating opportunities that make investment in workforce housing more feasible for private and nonprofit developers.

 

Future Land Use Plan: The subject property is located within the Oak Creek Sub-area, near existing education and civic centers.

RECOMMENDATION:

Staff recommends approval of the Type 2 Special Use Permit with the following conditions:

1. Existing firewall shall be maintained between the units.

 

Mailed notification as required by state statute:

Public hearing notices were sent to owners of 19 properties within 200 feet of the request. To date, the city has received no responses.
