BACKGROUND INFORMATION:

The City and New Braunfels Presbyterian Church previously entered into a lease agreement on December 13, 2004 which was thereby amended on April 21, 2015 for the lease of a parking lot constructed and maintained by the Church on the property owned by the City addressed as 345 Howard Street.  The parking lot is for the exclusive use by the Church on Sundays between the hours of 7:00am and 1:00pm.  At all other times, the parking lot is open to the public. 

 

 

ISSUE:

New Braunfels Presbyterian has requested the City exercise its option to extend the term of the lease for an additional ten years as provided for in the first amendment.  Along with the extension of the term, staff is recommending updating the insurance and indemnity language.  All other terms of the initial lease and first amendment will remain in full force and effect.

FISCAL IMPACT:

New Braunfels Presbyterian shall pay the city an annual rent payment for use of the lot of $200.00.  Additionally, the City shall have no maintenance obligations on the lot.

RECOMMENDATION:

Staff recommends approval of the second amendment to the lease.
