Discuss and consider approval for an Advanced Funding Agreement with TxDOT to construct Phases 1A and 1B of the Downtown Sidewalk Improvements Project.

BACKGROUND / RATIONALE:
The 2009 Downtown Implementation Plan (Plan) is intended to guide policy and funding decision making for the City, development community and other stakeholders in order to spur economic development projects in downtown New Braunfels. The Plan recommends improving accessibility and continuity in the sidewalk system by repairing or constructing broken or missing sidewalks, improving crosswalks around Main Plaza, and retrofitting sidewalks to ADA standards.
In 2011, the City of New Braunfels contracted with the landscape architecture firm Baker-Aicklen to develop a schematic design incorporating some of the Plan’s specific walkability, circulation and aesthetic recommendations. In 2012 Baker-Aicklen was contracted to complete the survey and design of the proposed sidewalk improvements. Baker-Aicklen provided 90% construction documents before going out of business in 2015.
On November 23, 2015, City Council approved a Task Order with the firm of RPS-Klotz Associates, Inc. under the City’s Indefinite Quantity/Indefinite Quantity (IDIQ) contract to complete the construction documents, assume ownership of the project as engineer of record, and provide construction administration services.
On July 11, 2016, City Council approved the issuance of an invitation for a Competitive Sealed Proposal (CSP) as the procurement method for the contract to construct Phases 1A, 1B, & 1C of this project along San Antonio St. The City received four proposals on September 21, 2016 and is currently in negotiations with the preferred bidder.
TxDOT has reviewed the proposed pedestrian improvements for Phases 1A and 1B within the Main Plaza which is contained within TxDOT ROW. Approval to work within the TxDOT ROW requires the execution of a standard Advanced Funding Agreement (AFA) which included the construction plans by reference in Exhibit A. In accordance with the City's existing Municipal Maintenance Agreement with TxDOT the AFA for this project stipulates that the City will pay for and maintain all improvements made by this project in TxDOT ROW.
