BACKGROUND / RATIONALE:

City staff is proposing amendments to Division 4 of Article VII of Chapter 126 of the Code of Ordinances regarding meters to update this ordinance, including renaming the section from Meters to Metered and Pay Station Parking. In addition, paid parking zones within the city will be moved from Section 86-7 and relevant definitions will be added to Section 126-1. Changes to specific sections are detailed below:

 

Sec. 86-7. Operation of vehicles in parks.

                     Referencing Sec. 126-381 for all paid parking within parks.

 

Sec. 126-1. Definitions.

                     Adding the definition of a holiday.

                     Adding relevant definitions for paid parking spaces and paid parking zones.

 

Sec. 126-381. Paid parking space and paid parking zones established.

                     Renaming this section from ‘Parking meter.’ to better reflect what is included.

                     Removing the reference to the downtown parking meters zones as these meters were removed in 1988.

                     Moving the paid parking zones for Prince Solms Park and Landa Park parking lots located off Elizabeth Avenue from Sec. 86-7.

                     Adding a paid parking zone on East San Antonio Street adjacent to Prince Solms Park.

 

Sec. 126-382. Installation and maintenance; authority of chief of police.

                     Removing references to parking meters and stating paid parking spaces and parking zones instead.

 

Sec. 126-383. Location; signals.

                     Updating this section to include criteria for paid parking spaces and paid parking zones.

 

Sec. 126-384. Marking spaces; method of parking.

                     Updating the text for how paid parking spaces should be marked.

                     Separating the criteria for method of parking in paid parking spaces and paid parking zones.

 

Sec. 126-387. Fee due for parking vehicle.

                     Renamed this section from ‘Deposit of coins; oversized vehicles.’ to reflect that payments other than coins are now accepted and that parking in more than one space will result in payment for all spaces occupied.

                     Added receipt display requirements for any pay stations that provide receipts.

 

Sec. 126-388. Time limits on paid parking.

                     Renamed this section from ‘Extending time prohibited.’ to better reflect the information in this section.

 

Sec. 126-393. Violations - Report; notice.

                     Moved the penalties from Sec. 86-7 to this section so that all information is together.

                     Provided enforcement jurisdiction for paid parking space and paid parking zone violations.

 

Sec. 126-395. Violations - Overtime parking prohibited; presumptive evidence.

                     Updating the presumptive evidence language to include provisions for non-metered parking spaces.

 

Sec. 126-396. Same - Fine; “Traf-O-Teria” payments.

                     This section is now reserved as this information is outdated with current city practices.

2006 Comprehensive Plan: Transportation Goal 21: Provide a system of convenient and safe transportation facilities through comprehensive, cooperative and continuing transportation system planning and development.

Recommendation

COMMITTEE RECOMMENDATION:

The impetus for changes to this ordinance comes from the River Advisory Committee.  The Committee wishes for the Council to establish the spaces along San Antonio Street, adjacent to Prince Solms Park, as paid parking similar to the paid spaces in Prince Solms Park. Should Council ultimately approve changes to this ordinance, staff will be back with that recommendation from the River Advisory Committee. 

 

STAFF RECOMMENDATION:

Staff will present the background and proposed amendments to Division 4 of Article VII of Chapter 126 of the Code of Ordinances regarding metered and pay station parking.
