Description:                                          17.958 acres proposed for 86 single-family residential lots, 1 Park

                                                               Lot, 2 Drainage Lots and 2 Open Space Lots

 

The subject property is located south of West Klein Road, east of FM 1044 and west of Walnut Avenue. The Legend Pond Master Plan and zoning of “Legend Pond” Planned Development District were both approved in 2002. Both have been amended several times since then.

 

The proposed preliminary plat for Legend Pond - Legend Meadow, Phase 5 includes the vacation of Lot 1, Dierks Subdivision (7 acres) and the creation of 87 single-family residential lots, 1 Park Lot, 2 Drainage Lots and 2 Open Space Lots

lot on a total of 17.958 acres.

 

Drainage:

The City’s Engineering Division reviewed the preliminary drainage report and plans as required by Section 118-51e of the Platting Ordinance in accordance with the requirements of Chapter 143 Municipal Drainage Utility Systems, and the Drainage and Erosion Control and Design Manual.  Final drainage review will be completed with review of the construction plans prior to submission of the final plat.

 

No portion of the subject property is located within the 100-year floodplain.

 

Utilities:

Legend Pond is within the Guadalupe Valley Electric Cooperative (GVEC) service area for electricity; the Green Valley Special Utility District (GVSUD) for water; and the Guadalupe Blanco River Authority (GBRA) for wastewater. Utility Easements have been provided as requested. Utilities will be extended as part of this plat and construction plans must be approved prior to submittal of the final plat.

 

Transportation:

The plat is in compliance with the Regional Transportation Plan. West Klein Road is designated as a 94-foot wide Minor Arterial and the current right-of-way width is 94 feet.

 

Klein Meadows is designated as a 60-foot wide Collector on the Regional Transportation Plan and the existing right-of-way of Klein Meadows complies with the plan.

 

Sidewalks:

4-foot wide public sidewalks will be constructed by the owner/developer adjacent to residential lots at the time of building construction and the developer will construct 4-foot wide sidewalks adjacent to non-residential use lots at the time of subdivision construction.   The City is requesting the developer escrow the cost of a 4-foot wide public sidewalk adjacent to Klein Road, as the developer would have been responsible for constructing a 4-foot wide sidewalk at this location had there not been an improvement project for Klein Road.  The sidewalk escrow will contribute toward the proposed 10-foot wide shared use path adjacent to this subdivision that is part of the Klein Road 2013 Bond Project.

 

Roadway Impact Fees:

The property is subject to Roadway Impact Fees and is located within Service Area 5.  Roadway Impact Fees will be assessed at the time of approval of the final plat. The Impact Fees will be collected at time of building permit as indicated in the then current fee schedule for the intended use.

 

Parkland Dedication And Development:

This plat is exempt from parkland dedication and development fees. However, as required by the “Legend Pond” Planned Development District Development Standards, the builder will pay $300 per lot at the time of building permit for a joint use City park.

 

STAFF RECOMMENDATION:

Staff recommends approval of the plat as it is in conformance with the “Legend Pond” PD development requirements and the approved Legend Pond Master Plan, with the following requirements to conform with the Platting Ordinance:

1.                     Label the length of the lot line shared by Lot 15 and Lot 903, Block 16.

2.                     The following note will need to be placed on the Final Plat “The cost of construction of a 4-foot wide public sidewalk adjacent to Klein Road has been escrowed with the City by the developer prior to recordation of this plat.”

3.                     Escrow for the construction of a 4-foot sidewalk adjacent to Klein Road will need to be submitted to the City prior to recordation of the final plat.
