Description:                     Platting 67.25 acres into 108 single family residential lots, 1 park lot and 4 open space lots

 

Background:

Oak Creek is a single-family residential subdivision zoned “Oak Creek” Planned Development District.  The PD Concept Plan and Subdivision Master Plan were approved in 2005.

 

Unit 4 plat consists of 67.25 acres for the proposed development of 108 single-family residential lots, 1 park lot and 4 open space lots.

 

Drainage:

The City’s Engineering Division reviewed preliminary drainage plans as required by Section 118-51.e of the Platting Ordinance and in accordance with the requirements of Chapter 143 Municipal Drainage Utility Systems, and the Drainage and Erosion Control and Design Manual. Final drainage review will be completed with review of subdivision construction plans prior to final plat application.

 

A portion of the subdivision is located within the 100-year floodplain (primarily Lot 908, Block K).

 

Utilities:

Electric, water and wastewater services will be provided by New Braunfels Utilities (NBU).  Utilities will be extended within this subdivision by the developer. Construction plans must be approved prior to submittal of the final plat. Utility easements have been designated on the plat as requested by NBU.

 

Transportation:

Regional Transportation Plan:

Orion Drive is designated as a 60-foot wide Minor Collector.  The portion of Orion Drive within the boundaries of this subdivision unit will be dedicated and constructed by the developer. 

 

Hike and Bike:

There is a proposed hike and bike trail along Alligator Creek within Lot 908, Block K.  This trail is to be constructed with a future project by the City after the lot has been dedicated to the City.

 

Sidewalks:

Four-foot wide sidewalks will be constructed per City standards along all interior streets in the subdivision.

 

Roadway Impact Fees:

Roadway Impact Fees for Service Area 3 will be assessed with approval of the final plat.  Impact Fees are collected at time of building permit as indicated in the then current fee schedule for the intended use.

 

Parkland Dedication and Development:

The Oak Creek Estates Subdivision Master Plan was approved prior to the adoption of the Parkland Dedication and Development Ordinance.  Therefore, the Parks and Recreation Department has determined the proposed development is exempt from parkland dedication and development requirements.  There is an amenity center with a swimming pool located in Unit 2B.  Lot 908 Block K is intended to be dedicated to the City.

 

Staff Recommendation:

Staff recommends approval as the proposed plat will conform to the approved PD Concept Plan and Development Standards, the applicant’s Master Plan and, with the following list prior to submittal of construction plans and final plat, will then meet the requirements of the adopted Platting Ordinance:

1.                     Update sidewalk note on plat to include all nonresidential lots. If they have already been constructed and are existing, state this in the note.

2.                     Include all existing and proposed sidewalks in the exhibit in addition to in the plat notes. 

3.                     Update common space note to account for both the land use and maintenance of all nonresidential lots.

4.                     Lots are indicated in the Common Space Note as “drainage, pedestrian and landscape easement”. Drainage easements shall be placed in separate common area lots as required in Sec. 118-51(e)(2)(d). Also, all easements shall be defined within lots; a lot shall not be labeled as an easement.

5.                     Revise plat note header “flood zone note” back to “floodplain note”.

6.                     Topographic contours are required on preliminary plats. Add contours to plat.
