Description:                     Replatting a 7.248 commercial lot into 3 commercial lots

 

The subject property is comprised of 7.248 acres fronting IH 35 and abutting Lake Dunlap, is zoned C-3 and C-4 and is currently undeveloped. 

 

The applicant is proposing to subdivide the one lot into 3 commercial lots

 

Drainage:

The City’s Engineering Division reviewed the preliminary drainage plan report and plans as required by Section 118-51e of the Platting Ordinance in accordance with the requirements of Chapter 143 Municipal Drainage Utility Systems, and the Drainage and Erosion Control and Design Manual. Final drainage review will be completed with review of construction plans prior to submittal of the final plat.

 

A portion of the subject property adjacent to Lake Dunlap is located within the 1% annual chance floodplain and the floodway has been labeled as a Drainage Easement.

 

Utilities:

Water, sewer and electric service will be provided by New Braunfels Utilities.  Utility easements are indicated on the plat as requested. Extension of public utilities will be required. Approval of construction plans is required prior to submission of a final plat.

 

Transportation:

Regional Transportation Plan:

This plat is in compliance with the City’s Regional Transportation Plan as there are no proposed thoroughfares within or adjacent to the subdivision.

 

Access:

Access will be provided to the subdivision from the IH 35 service road via a Shared Variable Width Egress-Ingress Easement located on Lot 1R-3.

 

Hike and Bike:

This plat is in compliance with the City’s Hike and Bike Trails Plan and no right-of-way dedication or hike and bike trail construction is required as there are no proposed trails within or adjacent to the subdivision.

 

Sidewalks

There are existing 5-foot wide public sidewalks adjacent to IH 35 that will remain.

 

Roadway Impact Fees:

The subdivision is subject to Roadway Impact Fees and will be assessed the fees for Service Area 6 with the approval of the final plat. The Impact Fees will be collected at time of building permit as indicated in the then current fee schedule for the intended use.

 

Parkland Dedication and Development:

Non-residential use subdivisions are not subject to park land dedication and development requirements, however, at such time that any dwelling units are constructed, the owner of the lot will be required to contact the City and comply with the ordinance for each dwelling unit.

 

STAFF RECOMMENDATION:

With the following requirements to comply with the adopted Platting Ordinance, Staff recommends approval:

1.                     Revise the preliminary plat to include the following revisions prior to inclusion within the construction plans:

a)                     Add a note to the final plat stating “Non-residential use subdivisions are not subject to park land dedication and development requirements, however, at such time that any dwelling units are constructed, the owner of the lot shall contact the City and comply with the ordinance for each dwelling unit.”.

b)                     Remove the “Corando Drive” label from the plat.

c)                     The 20-foot wide sewer easement intended to serve Lot 1R-1 must be a public sewer easement rather than private.

d)                     Provide the standard New Braunfels Utilities plat notes grouped together on the plat.

e)                     Provide a 20-foot wide Utility Easement centered over the existing sanitary sewer easements.

f)                     Revise the label of the “Variable Width Egress-Ingress Easement” to a “Shared Variable Width Egress-Ingress Easement”.

g)                     Delineate the boundaries of the Shared Variable Width Egress-Ingress Easement on Lot 1R-3.

h)                     Revise TxDOT note #3 to reference Lot 1R-3 rather than Lot 6.

i)                     Remove the abbreviations from the Abbreviations Table that do not apply to this plat.

j)                     11. Per Section 118-24(2.) the plat shall show the names and addresses of the engineer

k)                     and/or surveyor.  Provide information on plat.

l)                     Per Section 118-24(7.) include legal description of all adjacent properties.

m)                     All utilities not adequately provided for all lots. Per Section 118-43 adequate public facilities shall be provided to serve the development. Remove private sanitary easement callouts from plat as the infrastructure will be public.

2.                     Construction plans must be approved prior to submittal of the final plat.

3.                     Note: Conformance with master drainage plan report cannot be verified. At time of construction plans provide 3,000-ft downstream analysis to confirm no onsite detention is necessary.

4.                     All storm drainage and flood easements and all base flood elevations shall be shown on the final plat with a plat note stating that no development or building or structure is permitted within the easement and stating who will be responsible for maintaining the easement.

                     Inside Special Flood Hazard Area: All new constructions of substantial improvements in areas of special flood hazards shall be constructed 2 feet above the base flood elevation per Sec. 58-30(1.)(4.). Incorporate language into plat note.
