Acceptance of approximately 41 acres out of ABS 20 A.M. Esnaurizar Survey into the City of New Braunfels’ extraterritorial jurisdiction located west of SH 123 N and north of Harboth Road.

BACKGROUND / RATIONALE:

The City of New Braunfels entered into an interlocal cooperation agreement with the City of Seguin in December of 2018 regarding the adjustment of both cities’ shared extraterritorial jurisdiction (ETJ) boundary. That agreement established a new ETJ for both cities, plus some additional ETJ to be transferred to New Braunfels at a later date. This “Secondary Release Area” is presently outside of New Braunfels’ 3.5 mile statutorily authorized ETJ, but can be accepted by New Braunfels when New Braunfels:

1.                     Extends its corporate limits such that their 3.5 mile ETJ encompasses the Secondary Release Area, or

2.                     Increases to 100,000 in population inside its city limits which automatically increases its ETJ extent to 5 miles, or

3.                     “as otherwise authorized by state law” (property owner request).

 

The subject property is part of a larger tract that is predominantly within the City of New Braunfels’ ETJ. A 41 acre eastern portion of this tract lies within the agreed upon “Secondary Release Area”. The property owner is requesting this acreage be within New Braunfels’ ETJ to facilitate a streamlined development process with review and approval in its entirety by the City of New Braunfels.

Action 3.6: Pro actively provide a regulatory environment that remains business and resident friendly.  Strategy 8: Cultivate Local and Regional Partnerships The Regional Planning section encourages cross-jurisdictional collaboration to streamline processes and address common regional goals for improved quality of life.

 

FISCAL IMPACT:

Limited to application of ordinances applicable in the ETJ.
