Approval of the second and final reading of an ordinance repealing and reenacting Chapter 130, Article V, Division 4, of the Code of Ordinances as it relates to waste water pretreatment requirements.

BACKGROUND / RATIONALE:

On October 14, 2005, the Environmental Protection Agency finalized changes to the General Pretreatment Regulations for waste water by passing the Pretreatment Streamlining Rule that was enacted to reduce the regulatory burden on both industrial users and control authorities without adversely affecting environmental protection.  To comply with these regulations, New Braunfels Utilities (“NBU”) hired Freese & Nichols, Inc. (the “Consultant”) to revise and submit modifications of NBU’s Industrial Pretreatment Program to the Texas Commission on Environmental Quality (“TCEQ”).  The Consultant submitted a streamlining package to TCEQ on behalf of NBU on December 14, 2011, that incorporated changes to the following components of NBU’s pretreatment program:

 

                     Sewer Ordinance

                     Enforcement Response Plan/Guide

                     Standard Operating Procedures

                     Pretreatment Forms

                     Significant Industrial User (SIU) Permit Template

                     Attorney’s Statement

 

Late last year, TCEQ recognized the need to complete their initial review of our streamlining package and provided comments back to NBU on January 22, 2020.  Based on TCEQ’s comments, the Consultant made additional modifications to the NBU pretreatment program and resubmitted the streamlining package to the TCEQ on March 9, 2020.  TCEQ approved all of the modifications on April 24, 2020.  The final revisions include updates to the Sewer Ordinance, including definitions, additional language that allows for best-management practices, requirements for grease-interceptor service-documentation, interlocal agreement requirements for wastewater collected outside NBU’s jurisdiction, and additional requirements for industrial sample collection.

COMMITTEE RECOMMENDATION:

The NBU Board of Trustees, on August 27, 2020 adopted a resolution recommending repeal and reenactment of Chapter 130, Article V, Division 4, relating to waste water pretreatment requirements.
