Approval of a Memorandum of Understanding between the City and New Braunfels Utilities for the Construction of a Stormwater Treatment Basin at the NBU Well Yard at the Headwaters at the Comal facility

BACKGROUND / RATIONALE:
As part of the Edwards Aquifer Habitat Conservation Plan (EAHCP) program, the City has coordinated with New Braunfels Utilities (NBU) and Headwaters at the Comal staff on the design and construction of a stormwater treatment basin within the NBU well yard area situated within the Headwaters at the Comal facility. The intent of the project is to capture and filter stormwater runoff prior to entering Landa Lake and the Comal River system; minimizing the discharge of sediment and pollutants and providing a benefit to endangered species within the Comal River system.
Engineering design for the basin was funded by the City through the EAHCP program. Design has been completed and NBU/ Headwaters staff have been provided the opportunity to review and comment on the 60% and final plans. The City intends to fund construction of the stormwater treatment basin through the EAHCP program and solicit for a construction contractor with input from NBU/ Headwaters. The contract for the selected construction contractor will be brought forth to Council for consideration and approval at a later date.
The proposed Memorandum of Understanding (MOU) sets forth the terms and conditions for construction of the stormwater treatment basin. The MOU will be considered by the NBU Board at a later date.

FISCAL IMPACT:
The MOU specifies that the City will assume all costs associated with the project. However, through the City’s 2020 EAHCP Funding Application, this initiative has been approved by the EAHCP Implementing Committee and all costs for the project will be reimbursed to the City by the Edwards Aquifer Authority.
