BACKGROUND INFORMATION:

The Consent Resolution is the City Council’s authorization for the Comal County Water Improvement District to be formed. The proposed District includes approximately 1,888 acres of real property in Comal County, Texas described in the attached EEExhibit BU, which is located partially within the corporate limits and partially within the extraterritorial jurisdiction of the City of New Braunfels.

 

Texas Local Government Code, Section 42.042, states that land within the extraterritorial jurisdiction of a city may not be included within a district without the written consent of such city.  The next agenda item considers the City’s adoption of the Development Agreement, which addresses, among other things, the development of the property within the District and the provision of water, wastewater, and other utilities to the District.  This must be adopted as part of the adoption of the Consent Resolution.
