BACKGROUND INFORMATION:
This legal matter began in 2021 with the goal of removing recreational vehicles from the floodway. In March, 2022, the City filed a request for a temporary restraining order and a hearing was held in March and April. The case number is C2022-0386D and it is filed in the 433rd Judicial District Court. On May 17, 2022, the Court entered an order granting in part and denying in part the City’s request. This case is set for trial on August 4, 2022. It is in the best interests of the City that this firm continue to handle this representation.
ISSUE:
This law firm was hired last year under the city manager’s contracting authority. The litigation is pending and the budget will exceed the current contract authority, thus it is necessary to obtain contract approval from the governing body.
FISCAL IMPACT:
There is sufficient funding in the FY 2022 City Attorney’s Office Adopted Budget.

RECOMMENDATION:
Staff recommends continuation of the representation with the same legal counsel to represent the City to the conclusion of this litigation matter.
