BACKGROUND INFORMATION:

The City of New Braunfels established the Roadway Impact Fee Ordinance in 2007. The ordinance authorized the City to impose impact fees on new development within the City's corporate boundaries to generate revenue for funding or recouping the costs of transportation capital improvements or facility expansions necessitated by and attributable to new development.

 

City Council approved the Roadway Impact Fee Study, including maximum assessable roadway impact fees, in January 2020. City Council adopted collected roadway impact fees in February 2020 with an effective date of August 1, 2020. The adopted collected fees are 50% of the maximum assessable fees for residential land uses and 25% for non-residential land uses. Please note that City Council has the authority to establish the collected fees at up to 100% of the maximum assessable fees.

 

The adopted collected fees were based on a target of 65% of the maximum assessable fee for residential land uses and 50% of the maximum assessable fee for non-residential land uses. The target collected fees are a balance of addressing the impact of development on the transportation system in a specific service area with maintaining economic competitiveness. Other funding sources are required to complete transportation capital improvements attributable to new development

 

City staff has also identified transportation capital improvement needs for projects in the Roadway Impact Fee Capital Improvement Plan. The projects include funding design and/or construction of new traffic signals and intersection improvements at FM 1044 and Schmidt Ave, FM 1044 and County Line Road, Common Street and Old FM 306, and Barbarosa Road and FM 1101. The projects are associated with new development and the Texas Department of Transportation Highway Safety Improvement Plan. Staff is presenting this information for the possible direction of utilizing funds in the Roadway Impact Fee Program.

 

A tiered approach was presented to City Council in 2020 to reach the target collected fees. City Council directed staff to present the second tier and target fee to receive input from the community on updating the collected roadway impact fee. The input will be presented to City Council on August 22, 2022, for further direction.
