Approval of a resolution authorizing the City Manager to enter an Interlocal Agreement with Comal County to perform the duties of the City relating to collection of special assessments levied by the Solms Landing Public Improvement District (PID) under Chapter 372, Subchapter A, of the Texas Local Government Code (the PID Act).

 

 

BACKGROUND INFORMATION:

The Solms Landing PID was authorized by City Council on January 14, 2019.  The property is approximately 97 acres adjacent to the Creekside shopping area.  The purpose of the PID is to finance certain improvements authorized by the PID Act, that promote the interests of the City and confer a special benefit on the Assessed Property within the PID.

 

Per the PID Act, the Solms Landing PID has levied special assessments on properties within the boundaries of the PID.  The City has the authority to contract with the County to perform the duties of the City relating to collection of the special assessments levied by the PID.  This agreement will be for a one-year term and will automatically renew for successive one-year terms, unless terminated by either party.

N/A

 

 

FISCAL IMPACT:

There is no direct fiscal impact to the City of New Braunfels associated with the approval of the resolution referenced above.  Administrative costs incurred from administering the Solms Landing PID, will be covered from the assessments levied on the properties with the PID. 

 

Recommendation

RECOMMENDATION:

Staff recommends approval of the resolution authorizing the City Manager to enter an Interlocal Agreement with Comal County to perform the duties of the City relating to collection of special assessments levied by the Solms Landing PID under the PID Act.
