Description: Residential replat to create two (2) residential lots from one platted lot.

 

ISSUE:

The subject property is 6,500 square feet in area and is currently addressed at 2679 Katy Street and 2662 Second Street, located approximately 50 feet east of McGaugh Avenue. The replat is for the creation of two (2) residential lots from one lot.

 

The property was constructed as a townhome with one unit facing Katy Street (2679 Katy Street) and one unit facing Second Street (2662 Second Street). The proposed lot line would be located at the firewall that was constructed between the two units.

 

Drainage:

The Public Works Department reviewed project drainage with the Letter of Certification process as required by Section 118-51(e) of the Platting Ordinance and in accordance with the requirements of Chapter 143 Municipal Drainage Utility Systems and the Drainage and Erosion Control Design Manual. The proposed plat will maintain existing drainage conditions on the property and there will be no change in drainage.

 

Utilities:

Electric, water and wastewater services will be provided by New Braunfels Utilities (NBU). A 20-foot wide public utility easement is being dedicated along Katy Street.  NBU has indicated that separate utility services are required for each platted lot.

 

Transportation Plan:

The proposed replat is in compliance with the City’s Regional Transportation Plan. The project is not proposing streets within the subdivision.

 

Hike and Bike:

The plat is in compliance with the City’s Hike and Bike Trails Plan. There are no bike lanes or off-street paths indicated on the plan along the subject property.

 

Sidewalks:

Four (4) foot wide sidewalk is required to be constructed at the time of redevelopment along Katy Street.

 

Roadway Impact Fees:

The subdivision is located in Roadway Impact Fee Service Area 2.

 

Parkland Dedication and Development:

This subdivision is subject to the City’s 2018 Parkland Dedication and Development Ordinance.

Recommendation

RECOMMENDATION:

To meet the requirements of the City's Subdivision Platting Ordinance and other adopted codes, the plat must comply with the conditions noted below. Staff recommends approval of the proposed plat subject to the following Conditions of Approval:

1.                     The plat title is to be located at the center and top of the plat. (NBCO 118-21(c))

2.                     Revise the title of the replat to match the following statement (NBCO 118-34(g):

The title shall identify the document as a "Final Plat" of the "_______ Addition, Block _______, Lot(s) _______, being a Replat of Block _______, Lot(s) _______ of the _______ Addition, an addition to the City of New Braunfels, Texas, as recorded in Volume _______, Page _______ of the Plat Records of _______ County, Texas".

3.                     Provide a purpose for replat statement (NBCO 118-34(i)).

4.                     Add the following sidewalk note: Four (4) foot wide sidewalks will be constructed by the home builder per city standards at the time of building construction along:

a.                     Katy Street

5.                     Add the centerline and dimensions for Katy Street. (NBCO 118-29(b))

6.                     Label the New Braunfels City Limits on the Vicinity Map. (NBCO 118-24)

7.                     Provide a heavy line between the lots to delineate the area being replatted. (NBCO 118-21(c))

8.                     Remove the label indicating “Lot 17, Block 2….” at the top of proposed Lot 17B (NBCO 118-21(c))

9.                     Revise plat note #11 to correct the spelling of “buildable” and place the applicable Ordinance # (2023-77) in parentheses at the end of the note. (NBCO 118-21(c))

10.                     Water and wastewater main extension is required along Second Street in order to serve Lot 17B; this will include plan approval and bonding of the public infrastructure. (NBCO 118-51(a))

11.                     Be advised that water and wastewater capacity is not reserved until construction documents and plat approval. (NBCO 118-31(a))

12.                     Be advised final acceptance or performance bond for utility construction is required prior to plat approval. (NBCO 118-31(a))

13.                     Be advised that capital improvement projects addressing capacity issues as noted on Letters of Certification for utilities may be required to be completed prior to plat approval. (NBCO 118-21(d))

 

Approval Compliance:

To obtain approval of the final plat the applicant must submit to the City a written response that satisfies each condition of approval prior to expiration of the final plat (Section 118-32(b)). In accordance with Chapter 212, Texas Local Government Code, the City will determine the final plat approved if the response adequately addresses each Condition of Approval.

 

Mailed notification:

A public hearing notice was sent to the owner of 19 property within 200 feet. To date no responses have been received.
