ISSUE:

Mayfair is an 1,880-acre mixed-use development adjacent to the city limits in the ETJ in Comal County. It is situated east of FM 1102, west of FM 1101, south of Woods Path and Watson Lane East, and north of Kohlenberg Road, on both the east and west sides of IH 35 on the north end of New Braunfels. The development is subject to a Development Agreement entered into between the City and Southstar at Mayfair, LP, approved by the City Council on June 28, 2021, and recorded with the Comal County Clerk on February 9, 2022 (see Resource Link).

 

The Mayfair Development Agreement includes design standards, applications, processes, and improvements unique to this development. City Council provided direction on the unique standards of this development that are to be a model for future code changes and development inside the city limits, and to implement Envision New Braunfels. City Council also adopted the Development and Design Control Document (DDCD) that is the primary document regarding the design standards, processes and applications to which all development activity is reviewed and governed (see Resource Link).

 

DDCD proposed amendments:

Southstar Communities is proposing revisions to the DDCD to address the clarity needed throughout the document regarding missing-middle housing as well as a few other minor details as noted below:

                     PG. 23

-                     Revised keynote #2 regarding the requirement for mid to high rise dwellings to front collectors.

                     PG. 55

-                     Removed “for rent” from SC Single-Family Cluster Detached Residential

Product Type name title to clarify being allowed as rental or for sale.

-                      Section 1.1 revised to clarify both attached and detached single-family residences in a cluster configuration are permitted.

-                      Added Section 1.2 stating both “for rent” and “for sale (condo)” are allowed.

                     PG. 56

-                     Removed “for rent” from the title of the illustration.

-                     Revised statement to indicate parking will be formalized at permit submittal rather than at platting. Determining the parking configuration at the time of platting is not feasible.

                     PG. 57

-                     Reduced the minimum setback between structures for multifamily low density residential buildings side by side from 12 feet to 10 feet.

                     PG. 58

-                     Section 1.1 revised by eliminating the requirement for fronting multifamily high density development on arterials.

                     PG. 112

-                     Added definition of “Missing Middle Housing”: Buildings ranging in size and density between a traditional single-family detached home and a mid-rise apartment building.  A common characteristic of these multiple varieties of Missing Middle Housing is a scale comparable to a single-family house, but Missing Middle Housing always includes more than one housing unit. The varieties of Missing Middle Housing include, but are not limited to, single-family homes with ADU’s, duplexes, triplexes, fourplexes, courtyard apartments, mansion apartments, bungalow courts, townhouses, multiplexes, and live/work units.

RECOMMENDATION:

Staff recommends approval of the proposed amendments to the Mayfair DDCD as the amendments are in accordance with the Development Agreement, the general purpose and intent of the Mayfair development, and with Envision New Braunfels.
