BACKGROUND INFORMATION:

In response to a request by City Council, staff examined the ordinances regarding development-related waivers that have the most significant impact on community safety and/or the city budget. After staff presentation at the August 21, 2023 City Council meeting, City Council directed staff to prepare draft amendments to the subdivision platting ordinance to include options and alternatives to the current process for waiver consideration. Of interest was requiring these waivers to have a Planning Commission recommendation with the final decision to be made by the City Council only when staff and Planning Commission recommendations differ.

 

ISSUE:

Examination of the appropriate approval body for development-related waivers that have a fiscal impact on the budget, or a safety impact on New Braunfels citizens.

Recommendation

RECOMMENDATION:

Staff recommends approval of the proposed ordinance revisions to better serve the citizens of New Braunfels by requiring City Council input on waivers that impact community safety or those with a potential budgetary impact.

 

The Planning Commission held a Public Hearing on November 7, 2023, and unanimously recommended approval with some recommended minor word edits related to the identified city decision making authorities (7-0-0).
